Dealing With Racist Anti-Social Behaviour

We are clear in our tenancy agreement that we will not tolerate racist anti social behaviour from our residents.

Our residents’ responsibilities are:

'Not to cause or allow members of the tenant’s household or visitors to commit any form of discrimination, harassment or intimidation against neighbours or other residents or visitors because of their age, colour, disability or illness, marital status, occupation, race, religion, sex or sexuality.'

We will take legal action against any of our residents who carry out racist behaviour or allow people who are living with them or visiting them to carry out racist behaviour.

Agreeing A Course Of Action

When we talk to you we will meet you somewhere that you feel comfortable. This could be the housing office, your home, a relative’s house or somewhere else. You can decide. We will talk to you within 2 hours and meet you within 24 hours.

When we meet you we will need to know what has happened, when it happened, where it happened, how often it happens, how it affected you and how it has affected other people.

We will then agree a course of action with you to deal with the problem. The action plan will advise you what you need to do. It will also tell you what we are going to do and the deadlines we will work to. We promise to keep you informed of progress in your case by the time of the deadlines we have agreed. To resolve this problem we need to work together as partners and complete our side of the action plan.

There might be times when we think there is not a problem to resolve. Our undertaking is that we will be honest and straight with you and inform you when we think there is no case to answer.

Dealing with the person causing the problem

If a case is very serious we will take legal action straight away. If the witness statements and evidence show us that racist anti social behaviour is a problem, we will take action. The first step we will take will be to speak to the person causing the problem and tell them to stop their behaviour or risk legal action. If you would rather we did not do this then we will not speak to them. If you did want us to speak to them, we would confirm our conversation with them by sending a "first and final warning letter".

  • Legal action (Resolution)
    If this approach doesn’t solve the problem, or the problem needs to be dealt with immediately because it is urgent, we will start legal action. Some legal action can be taken very quickly and we are prepared to do this. When we go to court, we will ask the court for:
  • An Injunction 
    this is a court order that instructs the person causing the anti social behaviour to stop behaving in this way. Some injunctions granted by the court can be given within hours of the offence and some give the police specific powers to arrest the person if they do not behave. If the injunction is broken continuously the person could end up in prison.
  • An Anti Social Behaviour Order (ASBO)
     this bans the person causing the problem from coming into specific areas and hanging around with certain named friends. If the order is broken continuously the person could end up in prison.
  • An Eviction Order 
    this would be granted against our tenant (our tenants are responsible for the behaviour of their guests, including children).
